These Terms of Service ("Terms") govern your access to and use of the website located at voteglennbill.com (the "Site") and all communications, services, and features offered by Glenn Bill for State Representative – Indiana District 86 ("Campaign," "we," "us," or "our"). By accessing the Site, submitting a form, making a donation, or opting in to receive text or email communications, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

These Terms should be read together with our Privacy Policy, which is incorporated herein by reference.

1. Acceptance of Terms

By using the Site or any of our communications services, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction), have read and understood these Terms, and agree to be legally bound by them. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Permitted Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law or regulation.
  • Transmit any unsolicited or unauthorized advertising, promotional material, spam, or chain letters.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorized access to any portion of the Site or its related systems.
  • Interfere with or disrupt the integrity or performance of the Site.
  • Harvest or collect personal information about other users without their consent.
  • Use the Site to conduct any activity that would constitute a civil or criminal offense.

3. SMS / Text Message Terms (A2P 10DLC)

The following terms apply to all text message (SMS/MMS) communications sent by the Campaign using A2P 10-digit long code (10DLC) numbers registered with The Campaign Registry.

Message Types

By opting in, you consent to receive recurring automated text messages including: campaign news and updates, event invitations and reminders, volunteer requests and coordination, fundraising appeals, and get-out-the-vote communications. Message frequency varies based on campaign activity.

Opt-In Consent

You expressly consent to receive text messages from the Campaign by: (a) completing an opt-in form on the Site and checking the SMS consent checkbox; (b) texting a designated keyword to our campaign number; or (c) providing written or verbal consent to a campaign representative. Your consent is not a condition of any purchase or donation. Standard message and data rates may apply.

Opt-Out (STOP)

To stop receiving text messages from the Campaign, reply STOP to any message at any time. You will receive one final confirmation text and will not receive further messages unless you re-subscribe. You may also opt out by contacting us at [email protected].

Message and Data Rates

Message and data rates may apply. Consult your wireless carrier for details regarding your plan. The Campaign is not responsible for any charges imposed by your wireless carrier.

Carrier Disclaimer

Wireless carriers (including AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, U.S. Cellular, and MetroPCS) are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator.

No Third-Party Marketing Sharing

We do not sell, rent, or share your mobile phone number or SMS opt-in consent with third parties for marketing purposes. Your information is used solely to deliver Campaign communications as described in these Terms and our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

TCPA Compliance

Our SMS program complies with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and FCC regulations. We obtain prior express written consent before sending any campaign or promotional text messages. You may revoke consent at any time by replying STOP.

4. Email Communications (CAN-SPAM Act)

Our email communications comply with the CAN-SPAM Act of 2003 (15 U.S.C. § 7701 et seq.). Each campaign email we send will clearly identify the Campaign as the sender, use honest subject lines, include our physical mailing address, and provide a clear and easy mechanism to unsubscribe.

By submitting your email address through any form on the Site, you consent to receive campaign emails from us. You may unsubscribe at any time by clicking the "Unsubscribe" link in any email or by contacting us at [email protected]. We will honor all unsubscribe requests within 10 business days.

5. Donations and Campaign Finance Compliance

Donations made through the Site are political contributions to Glenn Bill for State Representative. By making a donation, you represent that:

  • You are a U.S. citizen or lawfully admitted permanent resident alien.
  • The contribution is made from your own funds and is not being reimbursed by another person or entity.
  • You are not a foreign national, federal contractor, corporation, labor union, or national bank making a contribution in connection with a federal, state, or local election.
  • You are at least 18 years of age.
  • The contribution does not exceed applicable Indiana campaign finance contribution limits.

Contributions are not tax-deductible as charitable donations. All donations are subject to Indiana campaign finance disclosure requirements and may be publicly reported. The Campaign reserves the right to refund any contribution that does not comply with applicable law.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, audio, and video, is the property of the Campaign or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

The Glenn Bill campaign name, logo, and related marks are trademarks of the Campaign. Unauthorized use of these marks is strictly prohibited.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE CAMPAIGN DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE CAMPAIGN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR COMMUNICATIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE CAMPAIGN IN THE SIX MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Campaign and its officers, directors, employees, agents, and volunteers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit to the Site.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Hamilton County, Indiana, and you consent to personal jurisdiction in those courts.

11. Political Disclaimer

This website is operated by and on behalf of Glenn Bill for State Representative – Indiana District 86, a political campaign committee. All communications, including emails and text messages, are political in nature and are paid for by Glenn Bill for State Representative. This website and its communications are not affiliated with any government agency, political party, or other campaign unless expressly stated.
